Protecting Our Elders: A Conversation with Elder Protection Attorney Ted Cook

Hi Ted, thanks so much for taking the time to chat with me today. I know you’re incredibly busy protecting our most vulnerable population here in San Diego.

What sparked your passion for Elder Protection law?

Well, it wasn’t one specific event but rather a culmination of experiences. Early on in my career, I saw firsthand how easily seniors could become victims of financial exploitation and neglect. It was heartbreaking to witness the vulnerability they faced.

Can you tell us a bit more about the process of Elder Protection?

Absolutely. Protecting our elders is a multi-faceted process that involves several key steps:

  • Initial Client Engagement
  • Case Assessment
  • Protective Actions
  • Legal Proceedings
  • Long-Term Planning
  • Case Resolution & Follow-Up

Let’s dive into one of those steps. How crucial is “Initial Client Engagement” and what does it entail?

I think Initial Client Engagement is the cornerstone of any successful Elder Protection case. It’s about establishing trust, understanding the client’s situation, and setting clear expectations.

We start with a thorough intake and consultation where we gather detailed personal background information and delve into the specifics of their case. This involves assessing their mental and physical capacity to ensure they can fully participate in legal decisions. Then comes a critical step – a conflict check to ensure I don’t have any prior relationships that could compromise my ability to represent them effectively.

“We’re so grateful to Ted for his compassion and expertise. He helped us navigate a very difficult situation with our grandmother and ensured she received the care she deserved.” – Mary S., La Jolla

>“Ted was incredibly patient and understanding when we were dealing with a complex financial exploitation case involving my father. He fought tirelessly on our behalf and ultimately secured a favorable resolution.” – David L., Point Loma

Have you ever encountered any challenges during this initial engagement phase?

Oh, definitely. One situation that comes to mind involved an elderly gentleman who was deeply mistrustful of anyone, especially lawyers. He had been scammed in the past and was understandably wary. It took several meetings and a lot of patience on my part to build a rapport with him. I assured him that I was there to protect his interests and ultimately he agreed to let me represent him.
