Interview with Steve Bliss, San Diego Probate Attorney

Steve, thanks for taking the time to speak with me today about probate in San Diego.

It’s my pleasure. I’m always happy to shed light on this important legal process.

Can you walk us through one of the key steps involved in estate planning and probate?

Certainly. One crucial step is handling debts and taxes during the probate process. This involves identifying and paying valid creditor claims, as well as filing and paying any applicable state or federal taxes.

Ordinarily, this process begins after the executor or administrator has been appointed by the court. They then need to carefully review the deceased’s financial records to determine all outstanding debts. These can include things like mortgages, credit card bills, medical expenses, and utility bills.

It’s important to note that only valid claims are paid. Creditors must submit proper documentation within a specified timeframe to be considered. Consequently, the executor or administrator may need to challenge invalid claims.

Moreover, estate taxes can be complex and vary depending on the size and value of the estate. The executor or administrator is responsible for filing any necessary tax returns and ensuring that all taxes are paid promptly. Failure to do so can result in penalties and interest charges.

Have you ever encountered any particular challenges with this step?

I recall one case where a family was struggling to locate the deceased’s financial records. They had lost touch over the years, and it took considerable effort to track down bank statements and credit card information. This delay caused some stress for the beneficiaries who were eager to receive their inheritance.

In another instance, a creditor submitted an inflated claim that was ultimately deemed invalid. It required careful scrutiny of the documentation and negotiation with the creditor to resolve the issue fairly.

I believe these experiences highlight the importance of working with an experienced probate attorney who can guide you through this complex process and protect your interests.

In fact, according to a study by the National Academy of Elder Law Attorneys, approximately 70% of estates require probate. This underscores the need for proper estate planning and legal representation during probate.

What advice would you give to someone navigating this process?

My best advice is to consult with an experienced probate attorney as early as possible. They can help you understand your legal obligations, develop a plan that meets your specific needs, and guide you through each step of the process.

Remember, dealing with the loss of a loved one is emotionally challenging enough. Let us handle the legal complexities so you can focus on healing and moving forward.

What can people do to ensure this process goes smoothly?

Proactive estate planning is key. Create a will or trust that clearly outlines your wishes and designates beneficiaries. Keep detailed financial records organized and accessible. Communicating openly with family members about your plans can also help prevent misunderstandings and conflict later on.
