Interview with Steve Bliss of Wildomar Probate Law

Good afternoon and welcome back to Wildomar News Today. I’m your host, Jessica Jones. We’re joined today by attorney Steve Bliss, founder of Wildomar Probate Law. Steve, thanks so much for being here.

The Importance of Estate Planning

Steve, let’s dive right in. Many people put off estate planning until later in life. Why is it important to start thinking about this now?

“Estate planning is essential for everyone, regardless of age or wealth,” says Steve. “It’s not just about what happens when you pass away; it’s about protecting yourself and your loved ones during your lifetime as well. A solid estate plan can help ensure that your assets are distributed according to your wishes, minimize potential taxes, and avoid lengthy and costly probate proceedings.”

Steve further explains the peace of mind that comes with knowing your affairs are in order: “Imagine not having to worry about what will happen to your family if something unexpected occurs. Knowing you have a plan in place can alleviate a lot of stress and anxiety.”

Understanding Testamentary Trusts

Let’s talk specifically about testamentary trusts, which I understand are created through a will. Can you elaborate on when these trusts are typically used?

“Testamentary trusts are often utilized for minor children or beneficiaries who may need additional support due to special needs,” explains Steve. “These trusts come into effect after the grantor’s death and are managed by a designated trustee. This ensures that the assets are used responsibly for the benefit of the beneficiary.”

Steve emphasizes the importance of careful consideration when setting up a testamentary trust: “It’s crucial to select a trustworthy trustee who understands your wishes and can effectively manage the assets. Moreover, outlining specific instructions regarding the distribution of funds and the beneficiary’s needs is essential.”

Avoiding Probate

“A common misconception is that a will automatically avoids probate,” notes Steve. “While a will outlines how assets are distributed, it still requires court supervision through probate, which can be a time-consuming and expensive process. Testamentary trusts, however, bypass probate because they are already established within the will.”

“Consequently,” he continues, “assets held within a testamentary trust are transferred directly to the beneficiary upon the grantor’s death without needing court intervention. This can save your loved ones significant time and money during an already difficult period.”

Challenges and Considerations

We’ve talked about the benefits, but are there any potential challenges or considerations when setting up a testamentary trust?

“One crucial factor is ensuring that the will clearly outlines the terms of the testamentary trust,” says Steve. “Without precise language, disputes may arise among beneficiaries regarding the trust’s administration and distribution of assets.”

He shares an experience: “I once worked with a family where the will lacked specific instructions for a testamentary trust intended for a child with special needs. This resulted in disagreements amongst siblings about how best to manage the funds, ultimately delaying the beneficiary’s access to crucial support.”

The Value of Legal Expertise

“This highlights the importance of seeking legal counsel from an experienced estate planning attorney,” emphasizes Steve. “A qualified attorney can help you draft a comprehensive will that clearly defines the terms of any testamentary trusts, minimizing potential conflicts and ensuring your wishes are carried out.”
