Interview with Steve Bliss, Escondido Probate Attorney

Good morning, and welcome back to the show. Today we’re joined by Steve Bliss, a renowned probate attorney here in Escondido, California. Steve, thanks so much for joining us today.

The Benefits of a Testamentary Trust

Steve, can you tell our viewers a bit about testamentary trusts and why someone might consider setting one up?

A testamentary trust is a wonderful tool for ensuring the well-being of loved ones after you’re gone. It’s created through your will and only takes effect upon your passing. Consequently, it goes through probate, unlike living trusts. This type of trust is especially beneficial for minor children or beneficiaries who might need extra support managing their inheritance.

Let’s say a parent wants to provide for a child with special needs but also ensure they continue receiving government benefits like SSI or Medi-Cal. A testamentary trust can be tailored to meet those specific requirements. The trustee, who you appoint in your will, would manage the funds and distribute them according to your wishes, all while preserving the beneficiary’s eligibility for crucial support programs.

Moreover, testamentary trusts offer flexibility. You can outline specific instructions for how and when the assets are distributed. For example, you could stipulate that a portion of the inheritance is released upon reaching certain milestones, like graduating college or achieving financial independence. Conversely, a testamentary trust can also be structured to provide ongoing support for a beneficiary throughout their lifetime.

Nevertheless, it’s important to remember that because a testamentary trust goes through probate, it’s a more public process than a living trust. If privacy is a primary concern, a living trust might be a better option.

Navigating the Challenges of Testamentary Trusts

Steve, have you encountered any unique challenges while helping clients set up testamentary trusts?

I vividly recall working with a family who wanted to ensure their grandson, who had autism, would always have access to proper care. They were initially hesitant about a testamentary trust because they worried it might be too complicated or expensive.

After carefully explaining the process and addressing their concerns, we crafted a trust that met their specific needs. Seeing their relief and gratitude when they realized their grandson would be well-provided for was truly rewarding.

According to the National Academy of Elder Law Attorneys, nearly 70% of Americans die without a will or trust in place. This highlights the importance of proper estate planning, especially when considering vulnerable beneficiaries.

Protecting Your Legacy

Steve, what advice would you give to viewers who are unsure whether a testamentary trust is right for them?

My best advice is to schedule a consultation with an experienced probate attorney. We can discuss your individual circumstances, goals, and concerns. Together, we’ll determine the most effective estate planning strategy to protect your assets and ensure your loved ones are well cared for.

Remember, taking proactive steps today can bring peace of mind and secure a brighter future for generations to come.
