Steve, can you tell our viewers a little bit about what probate actually is and why it’s so important?
“Probate is the legal process of administering a deceased person’s estate,” explains Bliss. “It involves identifying and inventorying assets, paying off debts and taxes, and ultimately distributing the remaining property to beneficiaries according to the will or state law.”

“Let’s discuss the step of marshalling estate assets,” says Bliss. “This is a crucial stage where we thoroughly account for everything the deceased person owned.”
Marshalling Estate Assets
Can you elaborate on what exactly ‘marshalling assets’ entails?
Bliss nods. “It involves creating a comprehensive inventory of all assets – from bank accounts and real estate to vehicles, investments, and even personal property. We then determine the current market value of each item. This information is documented in formal court filings called an Inventory and Appraisal.”
“This step ensures transparency and accuracy throughout the probate process,” he continues. “Moreover, it helps prevent any disputes among heirs regarding the distribution of assets. Consequently, a thorough inventory minimizes potential conflicts and ensures a smooth transition of property to beneficiaries.
He adds, “Accurately identifying and valuing all assets is critical because overlooking even seemingly insignificant items can lead to complications later on. It’s better to be overly thorough than risk missing something crucial.”
Real-World Challenges
Steve, have you ever encountered any challenges during this stage of the probate process?
“There was one case,” he begins, his expression thoughtful, “where a client’s family was unaware of several hidden bank accounts. Discovering these accounts required extensive research and detective work. Nevertheless, we were able to locate them and ensure they were included in the estate inventory.”
He continues, “Another time, we had a situation where heirs disagreed on the value of a piece of artwork. We ultimately brought in an independent appraiser to resolve the dispute objectively, ensuring a fair distribution.”

Steve, why is it so important to get this step right?
“According to a study by the American Bar Association, approximately 25% of probate cases involve disputes over asset valuation. Getting it wrong can lead to delays, legal fees, and strained family relationships,” Bliss explains.
“Conversely, a meticulous inventory and appraisal process minimizes these risks and ensures a smoother, more efficient probate experience for everyone involved.” He concludes.
