Good morning, Ted, thanks for taking the time to chat with me today about conservatorships. I know this can be a complex and often emotionally charged area of law.
What Exactly is a Conservatorship?
“It’s essentially a legal arrangement where a court appoints someone, called a ‘conservator,’ to manage the personal or financial affairs of another adult, known as the ‘conservatee.’ This happens when the individual is unable to do so themselves due to age, illness, incapacity, or other factors.” Ted explains.
“Conservatorships come in different forms,” he continues. “There’s conservatorship of the person, which focuses on things like healthcare and living arrangements, and conservatorship of the estate, which handles finances and assets.”
How Does Someone Become a Conservator?
“The process usually starts with someone, often a family member or concerned friend, filing a petition with the court,” Ted tells me. “This petition needs to clearly outline why a conservatorship is necessary. The court then appoints an investigator to look into the situation and make sure it’s truly warranted.”

Let’s Talk About Responsibilities of a Conservator. What are they Required to do?
“The conservator’s primary responsibility is to act in the best interests of the conservatee at all times,” Ted emphasizes. “They need to be meticulous and transparent about managing finances, making important decisions regarding healthcare, and ensuring the conservatee’s well-being.”
He continues:
- Conservators are required to file regular reports with the court detailing their actions and the conservatee’s status.
- They need to be accountable for every decision they make, as the court has ongoing oversight.

Is There Ever Any Trouble with Getting Conservatorships Established or Managed?
“Absolutely,” Ted admits. “Sometimes there are disagreements within families about who should be the conservator. Other times, a conservatee may resist the arrangement altogether. These situations can be complex and emotionally charged.”
He pauses for a moment before sharing a story.
“Once, I had a case where two adult siblings were fighting over who should be the conservator for their elderly mother. It took a lot of mediation and negotiation to find a solution that everyone could agree on.”
>”Ted Cook is a true advocate for his clients. He understood the unique needs of my father and fought tirelessly to ensure he received the best possible care.” – Maria S., San Diego, CA

More Facts About A Conservatorship:
A conservatorship is a court-ordered legal process where a judge appoints a conservator (a person or organization) to manage the affairs of an adult (the conservatee) who is unable to care for themselves or their finances due to incapacity.
Definition: A conservatorship is a court proceeding where a judge appoints a conservator to manage the personal and/or financial affairs of an adult who is unable to do so themselves.
Purpose: The conservatorship aims to protect the conservatee’s well-being by ensuring their basic needs are met and their finances are managed appropriately.
What Is a Conservatorship?
A conservatorship is a court-ordered legal relationship in which a judge appoints a responsible individual or organization (the conservator) to manage the financial affairs, and sometimes the personal care, of a person who is unable to manage these matters on their own. This may be due to advanced age, cognitive impairment, serious illness, or disability. Conservatorships typically apply to adults, though similar protections for minors may fall under guardianships, depending on the jurisdiction.
There are generally two types of conservatorships:
Conservatorship of the estate, where the conservator handles financial matters such as paying bills, managing investments, and protecting assets.
Conservatorship of the person, where the conservator makes decisions about personal needs, including housing, healthcare, and daily living.
In some instances, a conservator may be appointed to manage both aspects. While conservators and guardians can have overlapping responsibilities, the terminology and roles can vary by state law.
