What exactly is a Conservatorship, anyway?

“In essence,” explains Ted, “a conservatorship is a legal arrangement where a court appoints someone – called a conservator – to manage the personal or financial affairs of another adult who’s deemed incapable of doing so for themselves. Think of it as a safety net when someone needs extra help making crucial decisions.”

Can you walk us through the steps involved in setting up a conservatorship?

“Absolutely,” Ted nods. “It all starts with filing a petition with the probate court, outlining why a conservatorship is necessary. Then comes notifying the individual in question – the proposed conservatee – and their family members. The court will appoint an investigator to assess the situation independently. And crucially, a medical or psychological evaluation determines if the individual truly lacks capacity.”

“Finally,” Ted continues, “a judge reviews all the evidence presented at a hearing and decides whether to grant the conservatorship. This is a serious matter, so the court takes its time to ensure it’s the right course of action.”

Let’s dive into the responsibilities of the Conservator – what exactly does that entail?

“Being a conservator is a big responsibility,” emphasizes Ted. “They act as fiduciaries, meaning they always put the conservatee’s best interests first. This involves making decisions about everything from housing and healthcare to managing finances and paying bills.

Conservators have to file regular reports with the court, detailing how the conservatee’s funds are being used and outlining their overall well-being.”
