We begin by asking clients what they want to accomplish. Is it protecting their children? Ensuring a smooth transfer of wealth? Minimizing estate taxes? Charitable giving? The answers guide the entire process. We dig into family dynamics – blended families, special needs dependents, philanthropic interests – all play a role. It’s about understanding not just *what* you own, but *why* you own it, and what you hope to achieve with it.

Once we have a clear understanding of your objectives, we move onto gathering information – assets, liabilities, beneficiaries. This is where organization is key. What works today may not work in five or ten years. A marriage, a divorce, the birth of a child, a significant change in your financial situation, changes in tax laws—all these things necessitate a review. Many people create a plan and then file it away, thinking they’re all set. That’s a common mistake.

We recommend revisiting your plan at least every three to five years, even if nothing major has changed. During a review, we’ll assess whether your beneficiaries are still appropriate, whether your asset allocations align with your goals, and whether your tax strategies are still effective. We’ll also review any changes in the law that might impact your plan. It’s a proactive approach, ensuring your plan remains relevant and effective. We often use the analogy of a garden: you can’t plant it and expect it to thrive without ongoing maintenance. An estate plan is similar—it requires regular attention to ensure it continues to protect your interests.

For example, we had a client, let’s call him Mr. Henderson, who created his estate plan twenty years ago. He had two children at the time, and his primary goal was to provide for their education. By the time he came to us, his children were grown and financially independent. He also had a new grandchild he wanted to include in his plan. His old plan was completely outdated. This document allows you to express your wishes regarding medical treatment if you’re unable to make those decisions yourself. Without it, your family may have to make difficult choices on your behalf, and those choices may not align with your values. It’s important to remember that estate planning isn’t just about money; it’s about protecting your loved ones and ensuring your wishes are honored, even when you’re no longer able to speak for yourself.

About Estate Planning Law – Ted Cook

Ted enjoys working with clients to create a custom estate plan to protect their assets and to make sure their wishes are reflected in their estate plan. He treats each client as an individual and takes pride in the level of service he provides.

Ted graduated from the U.S. Air Force Academy and was commissioned an Ensign in the U.S. Navy. In the Navy, he was a Surface Warfare Officer and served on three ships on the West Coast. While in the Navy, Ted attended the University of San Diego School of Law where he received his Juris Doctrate degree in 1989. After law school, Ted continued his active duty service in the Navy as a Judge Advocate General Corps officer. After retiring from the Navy in 2011, Ted became a partner with Tom Henry in the law firm of Henry & Cook, LLP focusing on estate planning. Upon the passing of Tom Henry in 2022, Ted started his own firm and continues to help his clients create estate plans that are individually tailored to meet their needs.
